TERMS AND CONDITIONS
Your contract is with Masia Almanita S.L. (“we”, “us” and “our” in these Booking Conditions) for the property known as Masia Almanita (the “Property”). References to “you” or “your” are references to the person making the booking and all members of the party.
These Booking Conditions form the basis of your contract with us so please read them carefully. Nothing in these Booking Conditions affects your normal statutory rights.
- Making your booking
When you book the Property with us you should return the completed Booking Form to us together with your proof of payment for the Initial Deposit.
Your booking is made as a consumer for the purpose of a holiday and you acknowledge that no liability can be accepted for any business losses suffered or incurred by you during your stay at the Property or in connection with it.
Once the completed Booking Form and the Initial Deposit have been received and accepted by us, we will issue you with our written confirmation via e-mail to the address provided in the Booking Form. The contract between us will only be formed once we send you our written confirmation, and these terms and conditions are considered accepted by you.
We reserve the right to refuse any booking prior to the issue of our written confirmation. In such case, the Initial Deposit will be refundable.
Please carefully check the details of the confirmation and inform us immediately of any errors or omissions.
2. Paying for your booking and other costs
You are required to send the Balance of the Rental payment, a €1,750 + VAT cleaning fee, and a €2,500 Security Deposit (payable via a Swinkly link to block your card for this amount) to us at least 6 weeks prior to the Arrival Date, as set out in our written confirmation. We will send you a reminder about this, as well as for the tourist tax, for which the rate is 1 euro per night per adult.
If you fail to make such payments in full and on time, we may treat your booking as cancelled by you, without any right to a refund of the amounts already paid.
3. Cancellations
The Initial Deposit is non-refundable.
If it is impossible for your group to complete your booking due to local travel restrictions, we can offer a rebooking service for alternative dates.
We do not expect to have to make any changes to your booking. However, if an issue arises beyond our control and not attributable to you, we may need to make alterations or cancel your booking. In such case, we will contact you as soon as is reasonably practical and inform you of the cancellation or the change to your booking. If it becomes necessary to cancel your booking, we will refund the balance of any money you have paid us.
4. Your accommodation
You must arrive at your accommodation by 4pm on the Arrival Date, unless another time has been expressly agreed between us in writing, and you must leave the Property by 10am on the Departure Date. If your arrival is delayed, you must contact the person whose details are given on your booking confirmation so that alternative arrangements can be made. If you fail to do so, you might not be able to gain access to the Property on the Arrival Date.
In the event that you fail to arrive by midday on the day after the Arrival Date and you do not advise the contact of your anticipated late arrival, we may treat the booking as having been cancelled by you without any right to a refund of the amounts paid.
Use of the Pool Facilities:
- There is no lifeguard on duty at our properties, therefore, guests use the pool at their own risk.
- Young children should not be left at any time unsupervised.
- Never swim alone.
- Do not swim under the influence of alcohol.
- Please keep the pool area tidy. Do not leave objects such as toys or towels lying around, as they may pose a tripping hazard.
- Please use the plastic glasses provided near the pools and jacuzzi – we request that you use no glass in and around these areas as broken glass causes significant problems and would result in a withholding of the security deposit – specifically, if broken glass is found in the pool you will be fined €1,500, and €750 for the jacuzzi.
5. Event Information
Before you check out, it is mandatory that the property be restored to its original condition and all furniture moved back in its original position. If the furniture is not restored to its original position, we reserve the right to deduct the associated costs from the Security Deposit, specifically the tables and chairs on the courtyard and the sunloungers in the garden. If this is not done, we will withhold 150 euros from the security deposit for each space.
6. Catering at the Villa
You must inform us of all catering services that you will be using as soon as possible and, in any case, prior to the Arrival Date. The villa rental includes the use of the guest kitchen. For health and safety regulations, the professional kitchen is a separate entity, only to be used by professional caterers who have been approved by us before confirming a booking with them, and guest kitchen equipment is not available for use in the professional kitchen. Please let us know which caterer you are planning on using ASAP so that we can contact them directly regarding professional kitchen rental fees.
7. Wedding Planners / Coordinators
If you choose to use a wedding planner / coordinator who is not recommended by us, you must inform us of who you propose to use so that we can approve them beforehand. This will help to ensure that your wedding runs smoothly!
8. Your obligations
You agree to keep and leave the Property and the furnishings, kitchen equipment, crockery, glasses, bedding and towels in good condition.
You agree not to cause any damage to the walls, doors or windows of the Property or to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighbouring properties.
You agree to take all necessary steps to safeguard your personal property. No liability to you is accepted in respect of damage to or loss of such property, except where the damage or loss is caused by our negligence.
Our check-in time is at 4pm prompt – please let us know in advance if there are any delays to this time. It is not permitted to arrive early or leave luggage at the property before check-in.
You cannot allow more people to stay in the Property than expressly authorised, nor can you significantly change the makeup of the party during your stay in the Property unless it has been arranged in advance and it is shown on your confirmation. If you do so, we can refuse to hand over the Property to you, or can require you to leave it. We will treat any of these circumstances as a cancellation of the booking by you.
You agree to allow us or any representative of ours access at any reasonable time during your stay for the purpose of essential repairs and maintenance.
You agree not to allow any pets on site during your stay.
9. Complaints
Every effort has been made to ensure that you have an enjoyable and memorable stay. If, however, you have any cause for complaint it is important that remedial action is taken as soon as possible. It is essential that you contact us if any problem arises so that it can be speedily resolved. It is often extremely difficult (and sometimes impossible) to resolve difficulties properly unless we are promptly notified.
Discussion of any criticisms with us whilst you are in residence will usually enable shortcomings to be rectified straightaway. In particular, complaints of a transient nature (for example, regarding preparation or heating of the Property) cannot possibly be investigated unless registered whilst you are in residence.
If any complaint cannot be resolved during your holiday, you must write to us with full details within 28 days of the end of it to the address info@villaalmanita.com
10. Our liability
Our maximum liability for losses you suffer as a result of us acting in breach of these terms and conditions is strictly limited to the total amount paid for the booking.
11. Law
The contract between you and us is governed by the laws of the Kingdom of Spain and any dispute, matter or other issue which arises between us will be resolved by the courts of your domicile or those that may apply in accordance with the applicable law.
